These Terms of Use govern your access to and use of the HeyRua mobile application, website, learning content and related services.

HeyRua is operated by Beim Digital Ltd., an Irish company. In these Terms, “HeyRua”, “we”, “us” and “our” refer to Beim Digital Ltd. “You” and “your” refer to the person accessing or using HeyRua.

By creating an account, accessing HeyRua, purchasing a subscription, starting a free trial or otherwise using our services, you agree to these Terms of Use and our Privacy Policy.

If you do not agree to these Terms, you must not access or use HeyRua.

1. About HeyRua

HeyRua is an Irish language-learning platform designed to help users learn Irish through speaking, listening, pronunciation practice, interactive lessons, flashcards, guided conversations and related learning activities.

HeyRua is a learning aid. We do not guarantee that use of the service will result in fluency, a particular examination result, professional qualification or any other specific outcome.

Your progress will depend on factors including your starting level, participation, practice, consistency and individual learning needs.

2. Eligibility

You must be legally capable of entering into a binding agreement to use HeyRua independently.

HeyRua is not intended for use by children under 16 without the involvement and consent of a parent or legal guardian.

If you are under 16, your parent or legal guardian must review and agree to these Terms on your behalf before you create an account or use HeyRua.

A parent or guardian who permits a child to use HeyRua is responsible for supervising the child’s use of the service and for any activity carried out through the child’s account.

By using HeyRua, you confirm that:

• The information you provide is accurate and complete.
• You are legally permitted to use the service.
• You will comply with these Terms and all applicable laws.
• If you are acting for a child, you have the authority to accept these Terms on the child’s behalf.

3. Your Account

Some HeyRua features require an account.

You agree to:

• Provide accurate and current account information.
• Keep your login details secure.
• Not share your account with another person.
• Notify us promptly if you suspect unauthorised access.
• Accept responsibility for activity carried out through your account, except where that activity results from a failure on our part.

You must not create an account using another person’s identity or information without permission.

We may ask you to verify your identity or email address where reasonably necessary to protect your account, process a request, prevent misuse or comply with legal obligations.

You are responsible for maintaining access to the email address associated with your account.

4. Licence to Use HeyRua

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to access and use HeyRua for your own personal, non-commercial language learning.

This licence does not transfer ownership of HeyRua or any of its content to you.

You may not:

• Copy, reproduce, distribute, sell or commercially exploit HeyRua content.
• Share subscription access with another person.
• Record, scrape, download or extract substantial parts of the service.
• Reverse engineer, decompile or attempt to obtain HeyRua’s source code, except where applicable law expressly permits it.
• Circumvent any paywall, access restriction or security measure.
• Use automated systems, bots, scripts or scraping tools to access the service.
• Remove copyright, trade mark or ownership notices.
• Use HeyRua content to create, train or improve a competing product or service.
• Resell, sublicense or redistribute access to HeyRua.
• Use the service for unlawful, fraudulent or abusive purposes.

Any rights not expressly granted under these Terms are reserved by Beim Digital Ltd. and its licensors.

5. Apple App Store Terms

If you download or use HeyRua through Apple’s App Store, your use of the app is also subject to Apple’s applicable terms, usage rules and Licensed Application End User Licence Agreement.

These Terms are between you and Beim Digital Ltd., not Apple.

Beim Digital Ltd., rather than Apple, is responsible for HeyRua and its content, subject to applicable law.

Apple has no obligation to provide maintenance or support services for HeyRua.

If HeyRua fails to conform to an applicable warranty, you may notify Apple where permitted by Apple’s terms. Apple may refund the purchase price, if any, in accordance with its policies. To the maximum extent permitted by law, Apple has no other warranty obligation in relation to HeyRua.

Apple is not responsible for addressing claims relating to:

• Your possession or use of HeyRua.
• Product liability.
• HeyRua’s compliance with legal or regulatory requirements.
• Consumer protection or privacy claims.
• Intellectual property infringement claims.

Apple and its subsidiaries are third-party beneficiaries of the parts of these Terms relating to your App Store use. Once you accept these Terms, Apple may enforce those provisions against you as a third-party beneficiary.

Nothing in these Terms limits any rights you have under Apple’s mandatory terms or applicable consumer law.

6. Free Features and Paid Access

HeyRua may provide certain lessons, pronunciation activities, flashcards, conversations or other features without payment.

Access to other content or functionality may require a paid subscription.

The features included in free and paid access may change over time. We may add, remove, redesign or restrict features where reasonably necessary to operate, secure or improve the service.

We will not remove paid access already owed to you in a manner that unlawfully deprives you of the service you purchased.

The availability of a free feature does not guarantee that it will remain free permanently.

7. Free Trials

HeyRua may offer a free trial to eligible users.

The duration, eligibility requirements and terms of a free trial will be displayed before you begin the trial.

Unless you cancel before the trial ends, the subscription will automatically convert into a paid subscription and your Apple account will be charged the price displayed when you started the trial.

You may lose access to the remaining trial period when you cancel, depending on Apple’s applicable subscription rules and the offer presented to you.

Free trials may be limited to one trial per person, account, Apple ID, household or device.

We may refuse or withdraw a trial where we reasonably believe it is being misused, duplicated or obtained fraudulently.

8. Subscriptions

HeyRua may offer monthly, annual or other subscription plans.

The price, billing period, included features and any trial period will be shown before you confirm your purchase.

Subscriptions purchased through the iOS app are processed by Apple.

Your subscription will automatically renew at the end of each billing period unless you cancel it at least 24 hours before the end of the current period, or within any other cancellation timeframe displayed by Apple.

Apple may charge your account for renewal within 24 hours before the end of the current subscription period.

You authorise Apple to charge the applicable subscription price to the payment method associated with your Apple account.

Subscription prices may include applicable taxes depending on your location and Apple’s billing practices.

You can view and manage your subscription through your Apple account settings.

9. Cancelling a Subscription

You can cancel an Apple subscription through your iPhone settings:

1. Open Settings.
2. Select your name or Apple ID.
3. Select Subscriptions.
4. Select HeyRua.
5. Select Cancel Subscription.

Deleting the HeyRua app does not cancel your subscription.

Deleting your HeyRua account does not automatically cancel your Apple subscription.

Unless otherwise required by law or Apple’s policies, cancellation takes effect at the end of the current paid billing period. You may continue to access paid features until that period ends.

We cannot directly cancel an Apple subscription on your behalf because Apple controls App Store billing.

10. Prices and Price Changes

Current subscription prices are displayed in the app before purchase.

Prices may vary by country, currency, subscription type, promotional offer, tax treatment or App Store storefront.

We may change subscription prices from time to time. Where required, Apple will notify you of a price change and may request your agreement before the new price applies.

A price change will not retrospectively alter charges already paid.

Promotional prices, free trials and discounts may:

• Be available only for a limited time.
• Apply only to eligible users.
• Apply only to a particular subscription.
• Differ between users, countries or campaigns.
• Be subject to additional conditions presented with the offer.

The availability of a later discount does not create an entitlement to a retrospective refund or credit for an earlier purchase, except where required by law.

11. Payments and Billing

Payments made through the HeyRua iOS app are processed by Apple.

We do not receive or store your full payment card details for App Store purchases.

Apple may provide us with limited information about your transaction, including:

• The subscription product purchased.
• Subscription status.
• Trial status.
• Renewal or expiry information.
• A transaction or purchase identifier.
• Refund or cancellation status.

You are responsible for maintaining a valid payment method with Apple.

Billing issues, failed payments and App Store payment-method questions should normally be addressed through Apple Support.

12. Refunds

Refund requests for purchases made through Apple must normally be submitted directly to Apple and are handled under Apple’s policies and applicable law.

Beim Digital Ltd. does not control Apple’s decision to approve or refuse an App Store refund.

Nothing in these Terms removes or restricts any refund, repair, replacement, price reduction, cancellation or other remedy to which you are entitled under mandatory consumer law.

Where you believe HeyRua is faulty, materially different from what was described, or not supplied as agreed, contact us at hey@heyrua.ie so that we can investigate and, where appropriate, repair the issue, restore access or provide another remedy required by law.

13. Consumer Cancellation Rights

If you are a consumer in Ireland, the European Union or another jurisdiction that provides a statutory cooling-off period, you may have a legal right to withdraw from certain online contracts within 14 days without giving a reason.

Different rules may apply where:

• You request immediate access to a digital service.
• Performance of the service begins during the cancellation period.
• Digital content is supplied immediately.
• You expressly consent to immediate supply.
• You acknowledge that beginning supply may affect or end your withdrawal right.

Where Apple processes the transaction, requests relating to withdrawal, cancellation and refunds may need to be submitted through Apple.

Nothing in these Terms limits mandatory rights that cannot legally be excluded.

14. Restoring Purchases

Where supported, you may restore eligible App Store purchases through the restore-purchases function in HeyRua.

You must use the same Apple ID associated with the original purchase.

Restoration may fail where:

• The purchase was made using a different Apple ID.
• The subscription has expired.
• Apple cannot verify the transaction.
• The purchase was refunded or revoked.
• There is a temporary connection or App Store issue.

Contact hey@heyrua.ie if you experience a restoration issue. We may ask for limited purchase information needed to investigate, but you should not send us full payment-card details.

15. Learning Content

HeyRua’s lessons, translations, examples, pronunciation guidance, speech results and explanations are provided for educational purposes.

Irish can vary by dialect, region, speaker, context and level of formality. HeyRua may provide standard Irish alongside selected dialect or pronunciation options.

Although we aim to provide accurate and useful content, we do not guarantee that:

• Every valid translation or pronunciation variation will be included.
• Speech recognition will understand every speaker or accent.
• Every correction will be perfect.
• Content will be free from all errors.
• Use of HeyRua will produce a particular result.

You should not rely on HeyRua as the sole authority for legal, official, academic or professional translation.

16. Speaking and Voice Features

HeyRua includes speaking, pronunciation and interactive conversation features.

To use these features, you may need to grant microphone permission.

Voice features may:

• Record a short speech sample.
• Transmit audio for speech recognition or pronunciation assessment.
• Generate a transcript.
• Compare your speech with an expected phrase.
• Produce automated feedback, corrections or scores.

Speech recognition and pronunciation assessment are probabilistic technologies. Results may be affected by:

• Accent or dialect.
• Background noise.
• Microphone quality.
• Internet connection.
• Speaking volume or speed.
• Differences between valid pronunciations.
• Technical limitations.

A low score or correction does not necessarily mean your Irish is invalid or unintelligible.

You must not use voice or conversation features to submit unlawful, threatening, abusive, discriminatory, sexually explicit or otherwise harmful content.

17. Automated and Generated Feedback

Some HeyRua features may use automated systems to generate:

• Corrections.
• Translations.
• Conversation replies.
• Pronunciation feedback.
• Suggested answers.
• Learning recommendations.

Automated output may occasionally be inaccurate, incomplete or inappropriate.

You should use reasonable judgement when relying on generated feedback and may report errors to hey@heyrua.ie.

You must not rely on generated output as professional, legal, medical, financial or safety advice.

18. Acceptable Use

You agree not to use HeyRua to:

• Break any applicable law or regulation.
• Infringe another person’s rights.
• Harass, threaten, intimidate or abuse another person.
• Submit hateful, discriminatory, sexually explicit or exploitative content.
• Exploit or endanger a child.
• Impersonate another person or organisation.
• Upload malware, viruses or harmful code.
• Attempt unauthorised access to accounts, systems or data.
• Interfere with the operation or security of the service.
• Test vulnerabilities without written permission.
• Manipulate subscriptions, trials, scores or usage data.
• Make fraudulent payment, refund or support requests.
• Use HeyRua to develop or improve a competing product.
• Use content or outputs for unlawful or deceptive purposes.
• Use the service in a way that could damage HeyRua or other users.

We may investigate suspected misuse and take proportionate action, including restricting or suspending access.

19. User Content and Feedback

“User Content” means text, audio, messages, responses, feedback or other material you submit through HeyRua.

You retain ownership of your original User Content.

You grant Beim Digital Ltd. a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, process, adapt and transmit User Content only as reasonably necessary to:

• Provide HeyRua.
• Process learning activities.
• Generate feedback.
• Save your progress.
• Provide customer support.
• Secure and improve the service.
• Comply with legal obligations.

This licence ends when the content is deleted from our systems, except where continued retention is legally permitted or required, or where the content has been irreversibly anonymised.

You confirm that:

• You have the right to submit the content.
• The content does not violate another person’s rights.
• The content is lawful.
• The content does not contain unnecessary sensitive or confidential information.

Feedback, ideas and suggestions about HeyRua may be used by us without payment or obligation to you, provided that we do not publicly identify you without permission.

20. Intellectual Property

HeyRua and its associated intellectual property are owned by Beim Digital Ltd. or its licensors.

This includes, where applicable:

• The HeyRua name and branding.
• The Rua mascot and associated artwork.
• Logos, icons and visual designs.
• App design and user interfaces.
• Lessons, exercises and learning pathways.
• Audio, recordings and pronunciation materials.
• Text, translations and explanations.
• Software, source code and databases.
• Graphics, animations and videos.
• Subscription and paywall designs.
• Website content and marketing materials.

Nothing in these Terms grants you ownership of these materials.

“HeyRua”, related logos and associated branding may be trade marks or protected brand assets of Beim Digital Ltd.

21. Third-Party Services

HeyRua relies on third-party platforms and service providers, which may include:

• Apple and the App Store.
• Cloud-hosting providers.
• Authentication providers.
• Speech-processing providers.
• Analytics and crash-reporting providers.
• Subscription-management providers.
• Notification providers.
• Email and customer-support providers.

Your use of certain third-party services may also be governed by their own terms and privacy policies.

We are not responsible for an independent third party’s acts, omissions, service interruptions or terms, except where applicable law provides otherwise.

22. Links to Third-Party Websites

HeyRua may contain links to third-party websites, resources or services.

Links are provided for convenience and do not necessarily mean that we endorse or control the linked service.

We are not responsible for the content, availability, security or privacy practices of independent third-party websites.

You access third-party services at your own discretion and should review their applicable terms and privacy policies.

23. Availability and Changes to the Service

We aim to keep HeyRua available and functioning, but we do not guarantee uninterrupted or error-free access.

The service may be unavailable due to:

• Maintenance.
• Updates.
• Technical failures.
• Internet or network issues.
• App Store issues.
• Third-party service interruptions.
• Security incidents.
• Events outside our reasonable control.

We may update, improve, replace or remove parts of HeyRua.

Where a change materially affects a paid service, we will take reasonable steps to provide notice where required by law.

We may release app updates that are necessary for security, compatibility, legal compliance or continued operation. Some features may stop working if you do not install a required update.

24. Support

Support requests may be sent to:

We aim to respond within a reasonable period but do not guarantee an immediate response.

To help us investigate an issue, we may request:

• Your account email address.
• Your device and app version.
• Screenshots.
• A description of the problem.
• A limited App Store transaction identifier.

Do not send full payment-card details, account passwords or unnecessary sensitive personal information.

25. Account Suspension and Termination

You may stop using HeyRua at any time.

We may restrict, suspend or terminate your access where reasonably necessary because:

• You materially or repeatedly violate these Terms.
• You use the service unlawfully or fraudulently.
• Your activity creates a security risk.
• Your activity may harm HeyRua, our providers or other users.
• We are required to do so by law or a competent authority.
• Continuing to provide the account is no longer reasonably possible.

Where appropriate, we will provide notice and an opportunity to resolve the issue before termination. Immediate action may be taken where necessary to address fraud, illegality, security threats, serious abuse or potential harm.

Termination of your HeyRua account does not automatically cancel a subscription billed by Apple.

Sections intended by their nature to continue after termination will remain in effect, including provisions on intellectual property, liability, disputes and outstanding payment obligations.

26. Account Deletion

You may request deletion of your HeyRua account through the account or settings section of the app.

You may also contact hey@heyrua.ie if you cannot access the in-app deletion function.

Deleting your account will delete or anonymise eligible personal data associated with the account, subject to information that we are legally required or permitted to retain.

Account deletion may be subject to reasonable identity verification to prevent accidental or fraudulent deletion.

Deleting your account does not automatically cancel an Apple subscription. You must cancel the subscription separately through your Apple account settings.

27. Disclaimers

Nothing in these Terms excludes warranties, rights or remedies that cannot legally be excluded.

Subject to that restriction:

• HeyRua is provided on an “as available” basis.
• We do not guarantee uninterrupted or error-free operation.
• We do not guarantee that every speech result, correction or translation will be accurate.
• We do not guarantee a particular learning, academic or professional outcome.
• We do not guarantee compatibility with every device, operating-system version or network.
• We are not responsible for problems caused by unsupported devices, third-party systems or circumstances outside our reasonable control.

This section does not affect your mandatory rights in relation to digital content and digital services.

28. Limitation of Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

In particular, we do not exclude liability for:

• Death or personal injury caused by negligence.
• Fraud or fraudulent misrepresentation.
• Wilful misconduct.
• Breach of mandatory consumer rights.
• Any liability that cannot legally be limited or excluded.

If you are using HeyRua as a consumer, we are responsible for loss or damage that is a foreseeable result of our breach of these Terms or failure to use reasonable care and skill.

We are not responsible for loss or damage that:

• Was not reasonably foreseeable.
• Was caused by your breach of these Terms.
• Was caused by inaccurate information you supplied.
• Results from events outside our reasonable control.
• Relates to business activity where you use HeyRua primarily for commercial purposes.

HeyRua is intended for personal language learning. We are not liable for business losses, including loss of profit, revenue, opportunity, contracts, anticipated savings or business data, arising from personal consumer use of the service.

Any limitation in these Terms applies only to the fullest extent permitted by applicable law.

29. Indemnity for Business or Unauthorised Use

If you use HeyRua for business purposes, commercial exploitation, unlawful activity or in material breach of these Terms, you agree to compensate Beim Digital Ltd. for reasonable losses, liabilities and expenses arising directly from that use, to the extent permitted by law.

This section does not apply to ordinary personal consumer use and does not reduce your statutory consumer rights.

30. Events Outside Our Control

We are not responsible for delay or failure caused by circumstances outside our reasonable control.

These may include:

• Internet or telecommunications failures.
• Power outages.
• Cyberattacks.
• App Store outages.
• Cloud or speech-provider failures.
• Natural disasters.
• Government action.
• Industrial disputes.
• Public-health emergencies.
• Changes to law or platform requirements.

We will take reasonable steps to reduce the effect of such events and restore the service where practicable.

31. Privacy

Our Privacy Policy explains how we collect, use, disclose, retain and protect personal data.

By using HeyRua, you acknowledge that personal data will be handled as described in the Privacy Policy.

Where consent is legally required for a particular activity, we will request that consent separately.

32. Changes to These Terms

We may update these Terms to reflect:

• Changes to HeyRua.
• New features.
• Changes to subscriptions or payment arrangements.
• Changes to law or regulatory requirements.
• Security or operational requirements.
• Changes to third-party services.

The updated Terms will be published with a revised “Last updated” date.

Where a change is material, we will provide reasonable notice where required. We may ask you to accept updated Terms before continuing to use HeyRua.

Changes will not retrospectively remove rights you have already acquired under mandatory law.

If you do not agree to updated Terms, you should stop using HeyRua and cancel any active subscription before its next renewal.

33. Transfer of These Terms

We may transfer our rights and obligations under these Terms as part of a merger, acquisition, restructuring, financing or sale of all or part of the HeyRua business.

Any transfer will not reduce your mandatory legal rights.

You may not transfer your rights or obligations under these Terms to another person without our written consent.

34. Severability

If a court or competent authority finds that any provision of these Terms is unlawful, invalid or unenforceable, that provision will be treated as modified to the minimum extent necessary or removed.

The remaining provisions will continue in effect.

35. No Waiver

If we do not immediately enforce a provision of these Terms, this does not mean that we have waived our right to enforce it later.

A waiver is effective only where it is clearly given in writing.

36. Entire Agreement

These Terms, our Privacy Policy, the purchase information shown before you subscribe, and any mandatory Apple terms form the agreement governing your use of HeyRua.

They replace earlier representations or agreements concerning the same subject, except where applicable law provides otherwise.

37. Governing Law and Disputes

These Terms are governed by the laws of Ireland.

If you are a consumer resident in another country, you will also retain the benefit of any mandatory consumer protections provided by the law of your country of residence.

The courts of Ireland will have jurisdiction over disputes, but this does not prevent a consumer from bringing a claim in another court where mandatory consumer law permits it.

Nothing in these Terms restricts your right to contact a consumer-protection authority, data-protection authority or other competent regulator.
